Borough of Laurel Mountain Minutes

Regular Monthly Meeting Held March 18, 2009

Present: Griffith, Kinsey, Holland, O’Brien, Snyder, Solicitor Miller, Mayor Light

Absent: N/A

The meeting was called to order at 7:35 pm with a quorum present. The minutes of the February 4, 2009 meeting were approved as corrected. The following reports were submitted to council:

Borough of Laurel Mountain Minutes

Regular Monthly Meeting Held March 18, 2009

Present: Griffith, Kinsey, Holland, O’Brien, Snyder, Solicitor Miller, Mayor Light

The meeting was called to order at 7:35 pm with a quorum present. The minutes of the February 4, 2009 meeting were approved as corrected. The following reports were submitted to council:

OLD BUSINESS: Mayor’s Report:

Municipal Services Committee:

Mr. O’Brien reported that the borough has been awarded a grant for the Beachwood drainage project, however, due to funding issues the borough’s request has been reduced by approximately 25% to $7,830 this will require the borough to provide approximately $2,610 for the project. After discussion a motion was made by Mrs. Kinsey, seconded by Mr. O’Brien to accept the conditions of the grant and move forward with the Westmoreland Conservation District drainage project – carried. Mr. Light noted there may be other grant funds that will provide the $2,610 short fall; he will contact Mike Reese to see if there might be funding available.

Finance Committee:

A motion was made by Ms. Snyder, seconded by Mrs. Kinsey to approve Regis Tomsey, CPA to conduct the 2008 Borough audit – carried.

Solicitor’s Report:

A motion was made by Mr. Griffith, seconded by Mr. Holland to enact the Building Code Repealer Ordinance – Opting out of the administration of the Uniform Construction Code — carried. Cook Township will be contact for a listing of certified inspectors, the Department of Labor and Industry will now administer this code on behalf of the Borough.

NEW BUSINESS:

Mayor’s Report:

Mayor Light reported that during the month of January the police responded to one PFA in the borough, a criminal trespass and a verbal domestic violence incident. During February there was one ambulance assist. The police logged 5:20 hours in February, the total for the year 11:13.

Municipal Services Committee:

Mr. Holland noted that bids for Spring Road work will be solicited, specifications have been written and a map has been included which indicates areas to be addressed. The information also spells out that 70 tons of 2 Modified will be purchased by the contractor, with 60 tons to be used on roads and 10 tons to be kept in reserve. The deadline for return of bids is April 10 so that council can act at the April 15 meeting. A motion was made by Mr. Holland, seconded by Mr. Griffith to authorize the solicitation of bids for Spring Road maintenance – carried. It was noted that if bids are solicited telephonically, a record must be kept.

A motion was made by Mrs. Kinsey, seconded by Mr. Griffith to authorize retroactively the hiring of Laurel Mt. Tree Removal to clear a loose limb hanging over Laurel which is causing a safety hazard; this work will be done for $250 or less –carried.

Finance Committee: No new

Solicitor’s Report: No new business

Other:

Jordon Frye, Assistant to Mike Reese was present to offer assistance to the borough in carrying out the Open Records Act. Because the borough does not maintain regular office hours and due to the fact that records may be stored in various locations the borough was cautioned against delaying the release for information. Records may be requested by anyone not just residents of the state or municipality. There is helpful

information on the PHMC website regarding this act. This act provides that maps, books tapes and photographs are considered to be public record in additional to documents such as minutes, ordinances, resolutions etc.

The WCBA will hold its next meeting at the Westmorland Conservation District building at 7:00 pm, the speaker for this meeting will be Senator Don White for anyone wishing to attend.

Mrs. Kinsey announced that she will not be running for council. A write in candidate will need to be found, it was suggested that perhaps John Miller will consider this position.
