LMB COUNCIL MINUTES: APRIL 15, 2009

 Borough of Laurel Mountain Minutes  

Regular Monthly Meeting Held April 15, 2009

Present: Griffith, Snyder, Kinsey, Holland, O’Brien, Mayor Light, Solicitor Miller

Absent: N/A

The meeting was called to order at 7:30 pm with a quorum present. The minutes of the March 18, 2009 meeting were approved as corrected. The following reports were submitted to council 

Public Comment

William Fleming, Emergency Management Coordinator for the Borough reminded council that it is a requirement that they complete the online NIMS certification. Further, he asked that council consider the adoption of the Emergency Management Plan Previously provided. After discussion, a motion was made by Ms. Snyder, seconded by Mr. Griffith to adopt the Emergency Management Plan – carried.

Mr. Fleming also noted there will be an EMS seminar the Westmoreland county Community college on Wednesday, may 27 from 9 am to 3 pm for anyone interested in attending.

Westmoreland County is making available free laptops for municipal EMS coordinators; although the laptop is free the municipality must provide the internet connection which is approximately $50/month. If this offer is declined at this time, it will not be available in the future. Mr. Fleming noted that he has a laptop and internet connection and personally does not require the county laptop. After discussion, council opted out of this program.

Borough resident sue Crouse asked council to consider sending a letter to all borough residents to remind them of the speed limit, state dog laws and consideration for others in the community.

OLD BUSINESS:

Mayor’s Report: No old business.

Municipal Services committee:

Bids for Culvert repair were solicited with two contractors responding. Bids were received from B & B $1154.24 and Berkey Excavating $1,200, a difference of $446. After discussion the bids was awarded to B & B provided they carry proper insurance, and work can be completed by May 31, 2009, in the event that this insurance is not in place the bid will be awarded to Berkey Excavating.

Mrs. Kinsey solicited bids for spring road maintenance from Derry Construction, Ligonier Construction, and Berkey Excavating. Bids were received from Derry Construction and Berkey Excavating. Derry Construction provided a bid of $11,160.50; Berkey Provided a Bid of $6488 plus the additional cost of 70 tons of stone. After discussion, a motion was made by Mr. O’Brien, seconded by Mr. Griffith – carried.

Dust suppressant bids were solicited from Derry Construction and JMG these are the only two sources located for this service. The Derry Construction provided a bid of $19,745.50 for Bituminous Prime Coat, E-1 Prime (Emulsified Asphalt), JMG Provided a bid of 4410 for the application of 4500 gallons of Calcium Chloride. After discussion a motion was made by Mr. O’Brien to accept the JMG Bid of $4,410, this motion was seconded by Mrs. Kinsey – this motion carried with Mr. Holland, Mr. Obrien and Mrs. Kinsey voting for and Mr. Griffith and Ms. Snyder voting against the motion.

Mr. O’Brien reported that he will be meeting with two contractors to go over the Beechwood project in hopes that each will submit a bid for this work. He noted there are some questions regarding driveway culvert and how payment for this work is handled. It was noted that in past projects, culvert was purchased by homeowners and installed at the expense of the borough. Council secretary will forward a copy of this ordinance to Mr. O’Brien. There are three driveway culverts to be replaced under this project.

Mr. Holland requested a bid from Davis Construction for correcting the storm drain abutments at the Maple Road entrance as a possible use for the balance of the DCED funds this oral estimate was $2,000 for repairing the existing wall, $3,750 would be new retaining walls and $450 for the removal of the walls and leave with no edge.

Finance Committee

Ms. Snyder reported that Regis Tomsey has completed the audit in accordance with Pennsylvania law and GAP Accounting standards, the cost for this audit was $800.

NEW BUSINESS:

Mayor’s Report:

Mayor Light reported that after the last meeting he met with Mike Resse to discuss a DCED grant for $2,390, the amount need to complete the project associated with the Westmoreland Conservation district Grant. Mr. Light noted the grant was denied because DCED does not make grants for less than $5,000. After contacting the state, Mike Reese’s office reported that the grant was reinstated and increased to $5,000. Council will now need to provide a description of the additional work to be undertaken with DCED funds.

Mayor Light also reported that during the month of March the police logged 5:53 and provided two assists.

Mayor Light noted that has received complaints from residents regarding dogs running loose, he has referred the resident to the Department of Agriculture Dog Enforcement agent.

Municipal Services Committee: No new business

Finance Committee: No new business.

Solicitor’s Report:

Solicitor Miller reported that he reviewed the contract between the Borough and Comcast. He noted that it is a standard contract with a term of 15 years and a maximum franchise percentage of 5%. Comcast is proposing a 3% rate. Solicitor Miller noted that council should review before signing and might want to consider the higher percentage. This percentage would be a pass through tax to subscribers. Council Secretary will forward copies of this agreement to each council member for review. Council will act on this contract at the May meeting.
